Earnings for Retired STRS Members
Q. Has the cap been lifted on the maximum
earnings a retired STRS member can earn? Does this apply to all STRS retirees,
teachers, and administrators, or only classroom teachers? With the shortage
of administrative help, i.e., superintendent, principal, vice principals,
and CBO, I thought I heard it was applicable to all.
A. Under existing law, a STRS member retired for service may earn compensation for creditable service in any one school year up to $15,000, as adjusted, without a reduction in his or her retirement allowance. If a member retired for service earns compensation for creditable service in excess of that amount, his or her retirement allowance is reduced by the amount of the excess compensation.
Legislation signed into law this past week, AB 1736 (Ducheny, D-San Diego), provides that the earnings paid to a member who retired from service on or before July 1, 2000, and who is employed by a school district to provide direct remedial instruction to pupils in grades 2 through 12 are exempt from the above provisions if certain other conditions are met.
AB 1733 (Wildman, D-Los Angeles) is still on the Governor's desk. This bill
eliminates the current post-retirement earnings limitation for all STRS members
who first return to work more than one year after the date they retired and
it increases the current $19,650 earning limitation to $22,000 for STRS members
who return to work during their first year of retirement.
