Board of Governors to
Implement SB 361
Permanent Regulations
The Chancellor’s Office has provided notice of proposed regularity action to be taken by the Board of Governors (BOG) on the Permanent Regulations Implementing Senate Bill 361 (Chapter 631/2006).
Existing law, under SB 361, requires the BOG to adopt regulations to implement the new community college funding system. On January 16, 2007, the Board of Governors adopted such regulations on an emergency basis. At its March meeting, the BOG extended the emergency regulations until August 31, 2007.
At its May meeting, the Board plans to consider a proposed set of permanent regulations.
Section 206 of the Procedures and Standing Orders of the Board of Governors of the California Community Colleges requires the Board to give 45 days written notice of proposed regulatory action. Accordingly, notice is herby given that the Board of Governors of the California Community Colleges, at its meeting of May 7-8, 2007, will consider changes to regulations in Title 5, Division 6, of the California Code of Regulations. The adoption of the proposed regulations will not impose increased costs or new costs to community college districts that are required to be reimbursed under Section 17561 of the Government Code. Such determination will be made a formal part of the public hearing. Furthermore, there are no direct or indirect costs, no savings to any state agency, no costs or savings in federal funding to the state, and no discretionary costs to local agencies, nor is there any local mandate imposed.
The Board of Governors relies upon its authority under Education Code Section 70901(d) to delegate to the Chancellor authority to adopt the revised proposal on behalf of the Board of Governors.
