Board of Governors to Make Changes to Title 5 

At its May 7-8, 2007, meeting the Board of Governor’s (BOG) of the California Community Colleges will propose regularity changes to Title 5 Review and Revision—Chapter 6 Section. 

The changes to Title 5 affect curriculum standards, course repeatability, course approval, and related topics. The passage of Assembly Bill 1943 (Chapter 817/2006) requires the Board of Governors to adopt regulations allowing for stand-alone course approval at the local level. In addition, the BOG adopted emergency regulations to allow for enhanced funding of certain noncredit courses in January 2007. However, permanent regulations need to be in place by August 2007. The revisions include an expanded set of permanent regulations on the following: 

In addition, numerous sections will be amended or rewritten to eliminate outdated language, correct cross-references, and make other technical and editorial changes. 

The Board plans to consider a proposed set of permanent regulations. “Section 206 of the Procedures and Standing Orders of the Board of Governors of the California Community Colleges requires the Board to give 45 days written notice of proposed regulatory action. Accordingly, notice is herby given that the Board of Governors of the California Community Colleges, at its May meeting, will consider changes to regulations in Title 5, Division 6,of the California Code of Regulations.” (Chancellor’s Office) 

Consultation Council 

Revisions on the above topics were presented to the consultation council for review at its meeting on April 19, 2007. The council will have another opportunity to review the package at its May meeting, and if necessary at its June meeting, before the proposed regulation changes are finalized for action by the BOG in July. 

The adoption of the proposed regulations will not impose increased costs or new costs to community college districts that are required to be reimbursed under Section 17561 of the Government Code. Such determination will be made a formal part of the public hearing at the time and place described above. Furthermore, there are no direct or indirect costs, no savings to any state agency, no costs or savings in federal funding to the state, and no discretionary costs to local agencies, nor is there any local mandate imposed.  

The BOG relies upon its authority under Education Code Section 70901(d) to delegate to the Chancellor authority to adopt the revised proposal on behalf of the Board of Governors.
