Second District Court of Appeal Rules on Los Angeles Unified School District Takeover Bill.
On April 17, 2007, the Los Angeles Unified School District takeover plan, led by Mayor Antonio Villaraigosa, was dealt a second and likely final blow as the Second District Court of Appeals of the state of California unanimously ruled against the Mayor, citing the unconstitutionality of AB 1381 (Chapter 299/2006). Specifically, the Appellate Court found that the measure violated the rights of Los Angeles voters by shifting authority from board members elected by the voters to the Mayor in violation of the city’s charter. 

AB 1381, passed by the Legislature at the end of 2006, would have transferred significant authority over district operations and district budget to a council of mayors.
