$2.85 Million Settlement in SAT Lawsuit. Students who received mis-scored SAT tests have reached a settlement with The College Board, the nonprofit organization that owns the SAT, and NCS Pearson Inc., the company responsible for scanning SAT answer sheets.

 

Plaintiffs alleged that a scanning error affected about 1% of the tests administered in October 2005. The College Board and NCS Pearson have agreed to pay a total of $2.85 million into a settlement fund. About 4,400 students/plaintiffs are members of the settlement.

 

The students will have two options for payment under the settlement: (1) They can submit a short-form claim to receive a payment of $275, or (2) they can submit a longer form if they believe their damages are greater than that amount. There is no set limit on what students submitting individualized claims may receive.

 

According to The College Board, amounts remaining in the settlement fund after all claims are paid will be distributed to charitable organizations determined by the Court.
